The association of Diwan Al Madhalim with the new concept of authority is motivated by the possible existence of dysfunctions, abuses and administrative complications, the need to reinforce the means to defend citizens vis-à-vis the administration, bearing in mind the importance of non-judicial techniques, available for the control of the administration.

The belief that the mediator (the Wali) has become in democratic societies an efficient means to safeguard the balance between rights, public freedoms and the competences and prerogatives of the administration.

His Majesty is also fully aware that there are injustices that should be settled in order guarantee the respect of law, protect freedoms, and to put an end to iniquities, with a view to making law prevail, promoting citizenship and moralizing public services.

The methods and means to implement the new concept of authority by Diwan Al Madhalim are embodied in:

-Promoting communication between citizens and administration in order to push the administration to open its offices to citizens and handle their problems and issues honestly and efficiently and thus regain its credibility;

-Control by the Wali of administrations, using a modern approach, to complement the mission of the judiciary system and support the role played by the human rights advisory council;

-Considering that the Wali exerts a specific control, an evaluation, orientation and redressing control, through the investigation of complaints and settlement requests, and the invitation of the administration to take necessary measures and initiatives.

-Reporting to the Prime Minister the response of the administration to the files submitted to it.

-The annual report submitted to His Majesty the King, published partially or entirely in the Official Gazette upon His Majesty’s instructions.

Based on what preceded, it becomes clear that the new concept of authority is a means to settle grievances in one the two following ways:

-Safeguard of human rights, thanks to the relation established between Diwan al Madhalim and the human rights advisory council and the promotion of the concept of citizenship so that the citizen becomes an active actor in society;

-The leading role played by the Wali for the evaluation and reform of the administration by making remarks, recommendations and proposals aiming at improving the administration’s performance, correcting the dysfunctions, and amending the regulating texts.

In this way, Wali Al Madhalim is an influential and efficient active participant in the process of modernisation of administration and making it adjust to the new concept of authority and its sound implementation.
